Default Hyosung GV250 No Neutral?!

My Mother has a 2007 Hyosung Aquila GV250 with just over 6700km and since she bought it with 5400km it has never been able to go into neutral, it passed safety because our local dealer couldn't even figure out what's wrong with it. Their answer was its a common problem with no fix but I couldn't find anything else about it online which lets me to believe not a lot of other people are having this same issue.

The first owner did something while changing the transmission fluid and completely destroyed the transmission along with some engine components so the entire engine and transmission were replaced with a 2009 engine and transmission.

The bike rolls from first to fifth without a hitch but it will NOT go into neutral and it's really bothersome while sitting at red lights and I can't release the clutch to releave my sore hand from riding for hours as well as my mother who won't go for long rides because of this problem.

Are there some kind of linkage problems from a 2007 to 2009 that's causing the shifter to skip over neutral? I was thinking of replacing the whole shifter assembly at this point and rebuild it all with 2009 parts.

I'm not 100% positive but I think in 2008 they changed the gauge cluster in the GV and GT to have a gear indicator/ fuel gauge where the 2007 and older have a single fuel gauge only. Could this be a factor for the linkage not matching because it has a gear indicator so I'm sure the transmissions aren't exact which is where I believe changing the whole shifter to a 2009 model would help.

This is becoming a serious issue making neither of us want to ride the bike and I would like to fix it before the season is over.
