Wanted to get an early start to the day....at least until the garage door decided to come down ...BEFORE I got backed out of the garage!!!:mad:
Damage to my Jeep....door is *&^*% up....and the landlord, who doesn't fix nothing right....wants me to replace it!!! Yeah get right on that!!! AFter she pays my freakin deductible....
Then I can't get to work, have to call a sub...dad comes over and gets my jeep out of the garage...I get the sub all ready for work..in my crazy azz job....
Come back home, move the motorcycle...carefully out of the garage and move it to another so I can get it out tomorrow...this is gonna suck!!! have to find a new place for my bike....
But on the other hand...no cancer....Whew!... Heart is tickin' fine....dont' owe the back taxes ...on the ex does.....and I ate at Hog Haven and drank a lot of samples....and I am feeling good...:D

That's what I like about my little circle of friends. When one is down, there is another up. It helps to demonstrate that there is another day planned, and good things do come back to you.
I had a great day. Great coffee. Good work-out. A good ride, just a tad nippy. But hey, even a bad day riding is better than a good day working...
Got to the shop, and the mechanics needed a few knives sharpened. I had my little kit on Spinner, and we shared some coffee and a few laughs.
Just as I was packing up one of my clients called--one of my best clients. By the time I got home he was already there, and I sold him a knife in the driveway.
My guess, 4Raven, is this is how your 'tomorrow' is going to go. And lots of tomorrows in the future. And at some time your riding buddy--or a member here--is going to have it all crashing down. And they are going to need a good laugh, even if it's a laugh of total irony...:thumbsup:

It will all seem minimal after another good long ride on your scooter. :wink:
As for the landlord, do you have a body bag picked out yet?

Am I missing something here, gal? Isn't it the defective door that caused all the trouble? Why would you be responsible for any part of the damage the door caused?
I guess I've been away from apt/condo living so long it just seems foreign to me. If anything gets broke around here I just gotta go look in the mirror and under the couch cushions to see who's responsible and where the money's coming from. :confused:

Ya I agree with CIE. The land lord should be responsible for both the garage door & the jeep

is there anything in your lease requiring you to maintain the property? if not ... that is what the landlord DOES. supposedly.

The only thing I am responsible for is maintaining the property in an orderly fashion...I have my little garden that I take care of...the place is clean and orderly...Actually, when the new owners took over, I sent them a letter with the old lease agreement and their lease which told of any and all damages which were there upon moving in....In the letter I also stated what needed repairs...which included the garage door. That was nearly a year ago, so they raise the rent and the stuff still isn't repaired, then finally last week the door gets looked at, the maint. guy adjusts the door attachment rod and puts a new molding on the bottom of a door and the bottom panel is completely rotted....hmmmm the same panel I backed into when it was apparently falling in the track....but the landlords had replaced one or two other garage doors on other properties...guess it is time to move on:biggrin:....the place has become a dump...and we won't even go into what I have seen the landlord doing on a bike nite... :biggrin:
The landlord even called me once this month...and said.."I heard you have another dog...we will have to adjust your rental agreement".....first of all I only have one dog and do not know "where she came upon this little tidbit of info..." secondly, she worries about a second dog (on hearsay) but doesn't care about all the extra people living in the duplexes???mmmm like four extra bodies using extra water and sewer and four extra cars taking up parking space...:confused:

Get any evidence you can.
You may need it in court. This sounds like a landlord I once had...ended up in court to get my car repaired, also got a nice "rebate" on my rent.

Yeah I wouldn't claim that on the insurance. Put it on the home owners insurance.

Well that is what the adjuster just told me this evening...that letter I sent with the copy of the old lease agreement stating the problem with the door...yep....and they don't seem real eager to be paying for a new door either...he wants that letter! Glad i took it to work and copied it! Now I have to find it!:biggrin: She may be liable for my deductible as well...oh well she should have had the garage door people do the work....

Well I asked them about that and they said because of the damage to my vehicle...the adjuster said the amount on the claim will be minimal....
I am trying...but I have so much on my plate these next two weeks...it is really stressful...I actually got ill today...just too much at one time! May have to go back onto my aspirin regiment to reduce the stress on my heart...
Besides I will need to use my renters insurance when the huge tree that they had trimmed last year, falls on my place...it has splits all over ...taking pics of that too....so when it goes over, I can show that they knew it in advance. Took pics of my stuff too...so I can do a quick inventory...but how do you try to replace a 1915 Hoosier Cabinet with all the glassware?:o

I have no actual advice on the garage door problem since mine is always unoperational
but I just wanted to say you need to get out your bodybags and go to work. Im sure that will take care of your stress :thumbsup:

Landlord is usually responsible for keeping the property in livable order, well maintained. If he has not fulfilled his end of the agreement, the you could have a case against him. Legally you cannot reduce your rent to cover any of your expenses - but you can sue him for damages and, if you have it in writing that he is responsible, that will only work in your favor. If the conditions of the premises are such that you realistically cannot live there for fear of injury or worse, you may have a case for constructive eviction. You would have to contact your town's housing department to find out the exact wording of the laws in your town, but if the premises are unlivable, you can consider that to be a void agreement and you can move; and the landlord has no legal right to withhold any security deposit to cover rent after the date you move.
As for the dog, are these other places strictly no pets, or would any of them accept a pet deposit for her? Have you checked rentals on Craigslist? Sometimes you can find a good deal on there. I hope things start to go better for you soon!

Well I found my letter last night, so I will be making more copies today.:wink:
I just ordered more bags too...that made me sleep like a baby last night! Whew!:biggrin:
Yes Kat, I am checking with fair housing today...that is on my list. I can also put landlord rent in escrow account until all the items are taken care of, which also buys me time...to save for the downpayment on a house.
I may call the last place I looked at, so cute...and see if they would budge on the dog with a deposit. I just hate moving! Have to have a moving company do it, heavy furniture...they can do it in about 2-3 hours and be done with it...:o
Chances of moving out of state are slim...would have to take licensure tests for that state ....at least three of them:frown:

Well guess the findings of the adjuster looking at the Jeep and the garage doesn't mean squat, the adjuster handling the claim did exactly what I thought she would...she said there was no way that the door came down by itself unless the spring broke...Okay so I am a complete liar....even though I was right next to the opener, windows down, radio off, and never once saw it come on (since the opener in my Jeep is on the visor and too high to bump)...I am making it all up.
Also she said, if the landlord didn't fix it after a year...why do I still use the garage????:confused: Um...maybe cause I pay rent, want to take care of my vehicle and my bike and protect them from further damage!
She also said she didn't believe that the door came up by itself! Even though my neighbors all complain about their doors doing the same exact thing, and I had to go shut a neighbor's door just two days ago, and my neighbors have called me at work to tell me my garage door is up!!!
I want to apologize to all the members who have read my complaining....I lied about it all!!!:frown:
Or maybe it was just a dream??? Nightmare???
On the work front however, one of my co-workers still gets an extra 90 minutes in breaks!!! And is allowed to show up for work at 8:30 AM and the union said, basically they don't care!!!:eek:
I am 0 for 2...I can hardly wait until I go to court for the damages incured three years ago on my Jeep....
Maybe I will wake up tomorrow and it will just all go away!:smiley_mornincoffee

This may not be of any help but since your neighbors doors open mysteriously I have to ask. How many units are close by and does your landlord own all of them?
The above isn't completely relevent but I'd speculate your door mystery may too many other doors close by using the same frequency for the openers. I've seen that many times in neighborhoods where the same builder did them all.
Don't beat me (LOL) but unless the release cord is pulled or failed a door cannot fall without a break in the spring. That's why it may be the door openers around you.
Just a thought.

I'm guessing you have State Farm, Allstate, or Nationwide insurance. I'm in the insurance restoration business and they are the WORST! Have to agree with Bonsai though, it seems like maybe they are all on the same frequency. As for what happens if the tree falls and ruins your stuff, if it's dead it won't even be covered by the landlords insurance, only if it's a live tree with no damage, other than that they should have known and taken it out. Sorry for all the trouble you're having, but if you need help with the adjuster let me know, I deal with them all the time.

Well actually when I got out of the jeep and looked outside at the door, my next door neighbor's truck was there and had the door open, it had been closed when I went to get into my jeep....so maybe it was that???

More likely someone behind you or just up the street, if it was the next door neighbor it'd happen all the time or regularly. Those remotes have a short range but it can and does happen. Weather can affect the distance too and can explain why it only happens sometimes.
It's also a trick of thieves...drive through a neighborhood with a handful of remotes pushing them until a door opens. Then of course come back later. There's only so many frequencies used on the older ones without a scrambler.

We had to reprogram ours, we had some random openings/closings too.
I also had an issue with it a while back where the bottom seal of the door had gotten some dirty spiderwebs stuck to it, so when it was low enough to catch the beam, it would stop and go back up. sometimes closing it again worked and sometimes not.

Okay, I have been in court hearings fighting about an accident three years ago, I won that one (80-20%), I called the Progressive adjuster and just told them to pay it out...whatever...I really didn't have time to fight about what happened to the dang door! So that is finished and I got my money to pay for the repair on my Jeep and it was only a $100 deductible. Another plus
So now I am going to crash!!!:):smiley_mornincoffee
